CERTIFICATE OF OCCUPANCY

Required: A Certificate of Occupancy is required for this business permit.

Document Process: If you do not have a copy of a copy of the Certificate of Occupancy can be obtained from the following:

  • Property Owner
  • The City of Newark's OPRA Office located at City Hall, 920 Broad Street, Rm 415A, Newark, NJ 07102.
    NOTE: Small fee required with your request.

BUSINESS REGISTRATION CERTIFICATE

Required: To do business in the State of New Jersey, an entity must file organizational documents with the State of New Jersey, Division of Revenue and Enterprise Services.  This requirement applies to profit and non-profit corporations, limited partnerships, limited liability partnerships and limited liability companies.

Document Process: If you do not have a State of New Jersey Business Registration Certificate.

Required: A Fire Certificate is required for this business license.

Additional Fee: $75

Document Process: You can apply online for a Certificate and you will receive a confirmation from the Fire Department directly.  A fee of $75 is required to obtain the Certificate.

Police Warrant Record Check and SBI

Required: A Police Warrant check is required for this business license.

Additional Fee: $20 (via credit card)

Document Process:

Step 1: State Bureau of Investigation Report (SBI) Confirmation Number
  • APPLY ONLINE via NJPortal.com using online 212A Form: Request for a Criminal History Record Information (CHRI) for Non Criminal Justice purposes from the State of New Jersey State Police Department.
  • Click on ON LINE FORM 212A (Orange Block bottom left corner of screen)
  • ORI Number: NJNPD0000
  • Follow the prompts for demographic and payment information.
  • Upon completion, you will receive an email confirmation and receipt that will include a confirmation number.
  • Print the email confirmation for your records and to use for Business License application.
  • The request will be forwarded to the Newark Police Department for approval and returned to the New Jersey State Police for processing.
Step 2: Police Warrant Record Check
  • Upon completion of this online business license application, the Newark Police Department will run a background check on you (the applicant).
  • You will receive an email confirmation at the email address you have provided in 2 - 5 business days if you have any outstanding Police issues or not.
  • If you have any outstanding tickets/warrants, etc., the appropriate police procedures will apply. In some instances, you may be given a period of time to clear any outstanding charges.

Pursuant to N.J.S.A. 40:48C-14 et seq. and Revised City Ordinance 10:21-1 et seq., the city of Newark is authorized to impose and collect an Employer Payroll Tax at a rate of 1% of the employer's payroll. All businesses in the City of Newark are required by law to pay a Payroll Tax, unless you are one of the

following organizations:

  • The government of the United States.
  • The State of New Jersey or a county, municipality, school district or special district of the state.
  • An interstate government agency.
  • An agency or instrumentality of any entity enumerated in a, b or c above.
  • Any insurance company formed by authority of another state or foreign country, subject to the provisions of New Jersey statues annotated N.J.S.A.14:32-15.

Payroll taxes are paid quarterly and must be submitted by the last day of the month following the end of

the calendar quarter - April 30th, July 31st, October 31st, and January 31st each year your business is in

operation.

A copy of the payroll tax ordinance # 6S & FE maybe obtain by the City Clerk for the City of Newark, New Jersey calling 973 424-4117.

Additional Fee: $25  

Once you have completed this online application, a copy will be submitted directly to the City of Newark's Department of Neighborhood & Recreational Services for processing.

Once you receive the permit, it must be affixed to a window near the principle entrance to the commercial source so as to be easily visible from outside the structure, or if this is not possible, the permit is to be prominently displayed inside near the principle entrance.

You will need the following information requested to the right and attach copies of the following documents:

  • Contract for Waste Removal
  • Contract for Recycling Removal
  • Service Agreement Letter for Oil Removal (if applicable)
  • Service Agreement Letter for Motor Oil Removal (if applicable)
  • Service Agreement Letter for Tire Removal (if applicable)
  • Three (3) Months of Paid Invoices for Waste Removal

The Trade Waste Permit is good for one (1) year from the date of issue. It must be renewed annually.

A confirmation notice will be sent to you at the email address provided from the Department of Health and Community Wellness acknowledging your application.

A Health Inspection will occur at your place of business within 2 - 7 business days.

The Health Certificate is good for one year from the date of issue. It must be renewed annually.

Once received the Health Certificate must be posted in a conspicuous place near the public entrance of the establishment.
